At the request of PRO-MED AG (the owner and manufacturer of SmartDose® infusion systems) the Frankfurt based Court granted preliminary injunction that prohibits Fresenius-Kabi to promote and sell Ambix Anapa® infusion pumps in Germany.
The patent chamber of the first instance court of Frankfurt granted on January 25 th a preliminary injunction request by PRO-MED AG against Fresenius-Kabi's intentions to launch in Germany single use infusion pump systems Ambix Anapa® - made by e-WHA - with several SmartDose® patent infringing characteristics. This decision is prohibiting Fresenius-Kabi to manufacture, to sell, to market or otherwise promote the Ambix Anapa® products in Germany after the judgment will have been duly served on Fresenius. It confirms the strength of PRO-MED's SmartDose® patent family. Fresenius appeals this decision before the appeal court of Frankfurt.
