Health Warning Over DePuy Orthopaedics, Inc.'s Hip Implants

New York, New York (PRWEB) January 30, 2012 -- Bernstein Liebhard LLP reports that health regulators in Britain are concerned that recipients of the metal-on-metal DePuy ASR hip implants were never notified that the devices were recalled.* In August 2010, DePuy Orthopaedics, a subsidiary of Johnson & Johnson, issued a voluntary worldwide recall of its ASR hip implant systems, after receiving data from the National Joint Registry of England and Wales that 1 out of every 8 patients (12%-13%) who received the ASR hip implants had to undergo revision surgery within five years of implant.** At the time, DePuy sent letters to surgeons worldwide asking them to notify their patients of the recall. However, according to The Sunday Telegraph, this month, the British Orthopaedic Association sent letters to surgeons alerting them that they are concerned that some recipients may not have received the recall notice.*** Joe Dias, President of the British Orthopaedic Association, told The Sunday Telegraph that DePuy’s records show that just over one-third of patients who received the metal-on-metal ASR hip implants have participated in the recall. More than 40,000 patients in Britain received the implants that were the subject of the DePuy ASR hip recall. Although, Dias said it is possible that those affected by the recall could have undergone checks, without their details being centrally logged, he told the Telegraph, “My worry would be about cases where surgeons have retired, and no-one is following up on the patients they treated.” DePuy is unable to contact patients directly because they do not have access to patient medical records. Additionally, the Telegraph reported that DePuy is defending over a thousand hip replacement lawsuits in Britain stemming from the recalled ASR hip implants.

All Metal-On-Metal Hip Replacement Recipients Should Confirm Implant Model

In light of this latest development, the lawyers at Bernstein Liebhard LLP urge all individuals who underwent hip replacement surgery and received a metal-on-metal implant to call their doctors or contact the hospital where the surgery took place in order to find out whether they received a DePuy ASR hip implant. An estimated 37,000 Americans received the recalled ASR hip implants.

The DePuy hip recall lawyers at Bernstein Liebhard LLP are actively filing cases on behalf of individuals allegedly injured by the artificial ASR metal-on-metal hip implants in In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation (“MDL No. 2197"), which is currently underway in the U.S. District Court for the Northern District of Ohio.
