Eisai Inc. Commences U.S. Legal Action Over Aricept ODT(R) ANDA Filing

TOKYO and TEANECK, N.J., Aug. 4 /PRNewswire/ -- Eisai Co., Ltd. and Eisai Inc. (Headquarters: New Jersey, Chairman and CEO: Hajime Shimizu) today announce that they have filed a lawsuit against Mutual Pharmaceutical Co., Ltd. and United Research Laboratories, Inc. regarding its submission of an abbreviated new drug application (ANDA) to the FDA for Aricept ODT(R) Orally Disintegrating Tablets (Active Ingredient Name: donepezil hydrochloride). Eisai’s action was filed in the U.S. District Court for the District of New Jersey in Newark on August 3, 2006.

Eisai believes that its donepezil composition patent is valid until its expiration date of November 25, 2010. Eisai intends to vigorously enforce and defend that patent.

Aricept(R) is an acetylcholinesterase inhibitor and is believed to work by inhibiting the breakdown of acetylcholine, thereby increasing available levels of this chemical in the brain.
