U.S. District Court Dismisses Shareholder Derivative Action Against Merck & Co., Inc.

WHITEHOUSE STATION, N.J.--(BUSINESS WIRE)--May 16, 2006--Merck & Co., Inc. announced that on Friday, May 5, the United States District Court for the District of New Jersey dismissed a consolidated shareholder derivative action alleging that Merck’s officers and directors breached their fiduciary duties in connection with Merck’s development and sale of the prescription pain medicine VIOXX. The Court also denied the plaintiffs’ request for leave to amend their complaint.
