(Nasdaq: AQST), a specialty pharmaceutical company, focused on developing and commercializing differentiated products to solve therapeutic problems, today announced that the U.S. Court of Appeals for the Federal Circuit denied a motion for a rehearing to reinstate the preliminary injunction against Dr. Reddy’s Laboratory (DRL) regarding Suboxone® (buprenorphine/naloxone) Sublingual Film. This decision is not a judgement in the ongoing infringement cases against DRL and others regarding potential generic products entering the U.S. market. Any company, including DRL, introducing a generic alternative to Suboxone prior to the final court decision is doing so “at risk” with respect to the final outcome.
