LIVINGSTON, N.J., Oct. 20 /PRNewswire-FirstCall/ -- Milestone Scientific Inc. today announced that Telebrands Corporation had commenced an action in the United States District Court for the Southern District of New York against the Company and others charging them with false and misleading advertising in the sale and promotion of the Ionic White(TM) consumer tooth whitening system. The Company is the developer of the Ionic White(TM) system and the other defendants are alleged marketing partners of or distributors for the Company. The Plaintiff, a competitor of the Company in the marketing and sale of tooth whitening products, and a defendant in litigation previously brought by the Company and others for infringement of proprietary rights, seeks damages and a preliminary and permanent injunction against the alleged false and misleading advertising. Plaintiff’s application for a restraining order was denied by the Court and the court scheduled an evidentiary hearing on the requested preliminary injunction on October 28 2005. Milestone believes it has numerous meritorious defenses to the Complaint and intends to vigorously defend against it.
