ESTERO, Fla., Sept. 17, 2013 /PRNewswire/ -- Vision Pharma, LLC has initiated a civil action against Sunrise Pharmaceutical, Inc. of Rahway, New Jersey in U.S. District Court for the District of New Jersey, Trenton Division. The nine-count lawsuit seeks to recover at least $3 million from Sunrise Pharmaceutical, plus statute-imposed, mandatory treble damages and attorney fees pursuant to NJ Stat. Ann. § 56:8-19, stemming from Sunrise Pharmaceutical’s defective manufacture of certain drug products deemed adulterated and unsalable by the U.S. Food & Drug Administration (FDA) as well as Sunrise Pharmaceutical’s willful sale of said adulterated drugs to Vision Pharma without notice of the FDA’s investigations and determinations. The case is styled Vision Pharma, LLC v. Sunrise Pharmaceutical Inc., C.A. No. 2:13-cv-04692-CCC-JAD and is now pending before the Hon. Claire C. Cecchi.
