Mediware Sues Global Med To Recover Legal Costs Of Favorable Judgment

LENEXA, Kan., Dec. 20 /PRNewswire-FirstCall/ -- Mediware Information Systems, Inc. said it filed a lawsuit in the United States District Court for the Eastern District of California against Global Med Technologies, Inc. and its affiliate, PeopleMed, Inc. seeking to recover all legal fees, costs and other expenses incurred, which to date total over $700,000 (but which will continue to increase by the amount of recovery costs). These costs stem from successfully defending one of its management employees from a lawsuit brought by Global Med and PeopleMed in 2002.

Judgment in favor of the employee was entered in October 2004 on all claims contained in the underlying lawsuit, which alleged that the employee violated his former employment agreements with Global Med and PeopleMed by misappropriating certain trade secrets and improperly disclosing certain confidential information.

The employee and Mediware are now seeking reimbursement of their costs of defense, as specifically permitted by the terms of the employee's Global Med/PeopleMed contracts and the Uniform Trade Secrets Act.

Commenting on the California state court's decision, George Barry, Mediware's CEO said, "We are very pleased by the Court's decision and hope that by requiring Global Med to reimburse all of the legal fees and other expenses associated with this case, we will prevent frivolous and malicious claims by Global Med and its affiliates in the future."
