A judge will decide in the coming weeks whether a jury screwed up earlier this year when it found a Bergen County medical device executive guilty of tax evasion.
Thomas Fagan, former CEO of Energex Systems, was convicted following a trial in July of multiple counts of failing to file personal and business tax returns. He was acquitted on a single count of filing a fraudulent tax return in 2010.
The jury deadlocked on more serious second-degree charges, including misconduct by a corporate official.
