MONTREAL, Canada, May 2 /PRNewswire/ - Varian Medical Systems and Resonant Medical today announced that they have resolved the patent issues between the two companies and settled their outstanding litigation in return for certain payments to Varian. Varian and Resonant have also taken steps towards achieving interoperability between some of their radiotherapy products.
The agreement between Varian and Resonant includes an Interoperability Agreement that provides for the testing of connectivity and data interchange between the 4D Integrated Treatment Console for Varian’s Clinac(R) and Trilogy(TM) medical linear accelerators, and Resonant’s RESTITU(TM) Platform.
Both companies are pleased to have a comprehensive and constructive resolution which is positive for mutual customers. Radiation oncology clinics will continue to have access to all best available means to achieve the full benefits of image-guided and adaptive radiotherapy for their patients.
In the fall of 2005, Varian and SAS PRAXIM filed a complaint against Resonant at the U.S. International Trade Commission, Investigation No. 337-TA-555, and related litigation in the Federal District Court in the State of Washington. As part of this settlement, all patent and litigation issues between the companies have been settled. Under the terms of the settlement agreement, the financial details are not being disclosed.
