CINCINNATI, Aug. 31, 2006 /PRNewswire/ -- The Procter & Gamble Company (NYSE: PG - News) has reached a settlement in the lawsuit it filed on May 2, 2006 against Cumberland Swan Holdings, Inc. for trade dress infringement and false advertising of its Crest Pro-Health® oral rinse brand. Cumberland Swan denied those contentions, but has agreed to a Consent Judgment and will stop manufacturing, distributing and selling the infringing products. The remaining terms of the agreement were not disclosed.
“This case was about consumers being misled into believing that they were buying products comparable to Crest Pro-Health,” said Jim Johnson, P&G’s chief legal officer. “We’re satisfied that Cumberland Swan must now compete with its own designs and substantiate its performance claims with meaningful testing, as we do,” added Johnson.
