Federal Judge Dismisses Derivative Lawsuit Against Cell Therapeutics, Inc.

SEATTLE, Sept. 12 /PRNewswire-FirstCall/ -- Cell Therapeutics, Inc. (CTI) (Nasdaq: CTIC; MTAX) announced today that U.S. District Judge Ricardo S. Martinez granted CTI's motion to dismiss a shareholder derivative complaint (Terence Fernandes v. James A. Bianco, et al; filed May 9, 2005) in which plaintiffs had alleged breaches of duties by CTI's directors. The case was dismissed with prejudice on August 23, 2006 and the matter has concluded. Previously, on June 8, 2006, Judge Martinez dismissed a private securities fraud class action lawsuit filed against CTI November 7, 2005, which included similar allegations related to XYOTAX.
