NEW YORK, Sept. 22 /PRNewswire/ -- The 500-attorney national law firm of Edwards Angell Palmer & Dodge announced today that its clients, Takeda Pharmaceutical Company Limited and Takeda Pharmaceuticals North America, Inc., have prevailed in a fees motion involving the patent infringement action against generic drug manufacturers challenging Takeda’s patent on ACTOS(R) (pioglitazone hydrochloride), a popular oral antidiabetic agent. In a 51 page opinion & order, the Honorable Denise J. Cote of the U.S. District Court for the Southern District of New York granted Takeda’s motion for an award of attorney’s fees against Alphapharm Pty. Ltd. and Mylan Laboratories, Inc.

Edwards Angell Palmer & Dodge filed patent infringement actions against four generic drug manufacturers in response to their filing of Abbreviated New Drug Applications (ANDAs) with the FDA under provisions of the Hatch-Waxman Act, challenging certain of Takeda’s patents relating to ACTOS(R) including U.S. Patent No. 4,687,777, which covers its active ingredient, pioglitazone hydrochloride.
