DENVER, July 3, 2018 /PRNewswire/ -- On June 27, 2018, a jury in the U.S. District Court for the District of Colorado returned a verdict in favor of plaintiffs in three consolidated cases against DaVita, Inc. (“DaVita”) in the amount of $8.5 million in compensatory damages and $375 million in punitive damages. Plaintiffs in the case were represented by Robert B. Carey, Molly A. Booker, and Tory Beardsley of Hagens Berman Sobol Shapiro LLP and Stuart M. Paynter, Jennifer L. Murray, Celeste H.G. Boyd, and Sara C. Willingham of the Paynter Law Firm PLLC.

Defendant DaVita is one of the largest operators of dialysis centers in the United States, with a network of over 2,000 outpatient dialysis centers throughout 44 states and the District of Columbia. Plaintiffs were family members of individuals who died after being treated at DaVita clinics. They alleged that DaVita administered an acid concentrate, GranuFlo, without informing the patients or their doctors that GranuFlo could affect their acid-base balance and trigger cardiac arrest.

The case went to trial in June 2018 after several years of litigation, and plaintiffs prevailed. Stuart Paynter, one of the attorneys for plaintiffs, stated, “Plaintiffs lost their loved ones as a result of DaVita’s failure to follow basic safety practices. The jury sent a clear message that such misconduct will not be tolerated.”
