Medtronic (NYSE:MDT) wants a federal judge in Arizona to reconsider his decision not to dismiss a lawsuit filed over its Infuse bone-growth protein. Fridley, Minn.-based Medtronic had asked Judge G. Murray Snow of the U.S. District Court for Arizona to toss the case, on the grounds that the product was protected by federal preemption, which has protected many medical device makers by effectively squashing liability lawsuits against products approved by the FDA.
