Mallinckrodt Inc. Pays $3.5 Million to Settle Kickback Charges

Three days after the US Department of Justice formally joined a whistleblower lawsuit against Mallinckrodt, the drugmaker has agreed to pay $ 3.5 million to settle charges that kickbacks were paid to physicians to prescribe certain drugs and that the ensuing activity caused Medicare and Medicaid to be overcharged. The details tell a familiar tale. Specifically, Mallinckrodt paid physician to participate in speaker programs, clinical trials and meetings, or in some cases, complete forms that provided them incentives to write prescriptions for the Restoril sleeping pill, the Magnacet painkiller and the Tofranil antidepressants, or their generic equivalents.
