Everett Laboratories Files Patent Infringement Lawsuits Against Competitor Acella Pharmaceuticals, LLC

CHATHAM, N.J., July 8, 2013 /PRNewswire/ -- Everett Laboratories, Inc., a leader in the field of nutritional products and prenatal supplementation, today formally announced that it has filed three patent infringement lawsuits and associated motions for preliminary injunctions in the United States District Court for the District of New Jersey against Acella Pharmaceuticals, LLC: (1) Case No. 13-3470 pertaining to Acella’s PNV-First product, which is a direct copy of Everett’s Vitafol®-One prenatal nutritional supplement product and infringes Everett’s U.S. Patent No. 8,183,227; (2) Case No. 13-3487 pertaining to Acella’s Choice-OB+DHA, which is a direct copy of Everett’s Select-OB®+DHA prenatal nutritional supplement product and infringes Everett’s U.S. Patent No. 8,197,855; and (3) Case No. 13-3529 pertaining to Acella’s “PNV - OB with DHA” product that is a direct copy of Everett’s Vitafol®-OB+DHA prenatal nutritional supplement product and infringes Everett’s U.S. Patent No. 6,814,983 and U.S. Patent No. 7,390,509.

Everett’s lawsuits seek to immediately and permanently prevent Acella from making, selling, and distributing in the United States its infringing, copycat products. Everett has specifically moved in each case for immediate relief, explaining how it will be irreparably harmed unless the court issues a preliminary injunction requiring Acella to immediately withdraw its patent-infringing products from the marketplace.
