BETHESDA, Md., Sept. 22, 2014 /PRNewswire/ -- Spherix Incorporated (SPEX) -- an intellectual property development company committed to the fostering and monetization of intellectual property, today announced that the United States Patent & Trademark Office (USPTO) issued a new patent to the Company in the month of September that is part of a standard essential family of patents.

The issued patent is: USRE45,121

  • Application number: US 13/728,867
  • Publication date: Sep 9, 2014
  • Filing date: Dec 27, 2012

The listed inventors of the new patent, entitled “VLAN frame format,” are Paul J. Frantz and Geoffrey O. Thompson. The patent relates to the field of data communications. More specifically, the patent relates to a method and frame format for preserving in a data frame the virtual local area network (VLAN) associated with the data frame as determined by a network device from which the data frame was received when transmitting the data frame over a communications medium shared among multiple VLANs.

CEO Anthony Hayes stated, “Several recent court decisions unrelated to Spherix demonstrate the volatility associated with only having a small number of patents to assert. The issuance by the USPTO of yet another standard essential patent to Spherix helps broaden our licensing potential and gives us great monetization diversity potential. This new patent is in addition to the three standard essential patents issued to Spherix in August. We believe that our portfolio has only been strengthened in the last year, which is giving our licensing team further runway to pursue additional licensing revenue.”

“In addition, we note that Huawei answered our complaint on September 8th,” continued Mr. Hayes “A copy is available on the U.S. District Court website and note that Huawei did not file any counter-claims against Spherix. Finally, in our case against Verizon, the Court set a Markman date for March 16th. As with any date set in litigation, the date is subject to change.”
