Merck & Co., Inc. Loses Trade Secrets Battle in Canada

Pharmaceutical giant Merck Frosst, which lost its legal battle Friday to keep what it considers to be trade secrets exempt from Canada’s access-to-information legislation, expressed “disappointment” but said it will abide by the Supreme Court of Canada’s decision. “With respect to the decision of the Supreme Court of Canada, Merck is disappointed with the outcome but takes comfort in some of the Court’s comments and direction,” Merck Frosst Canada spokesperson Sheila Murphy told Postmedia News in an email. She referred to the court’s view that the government “has an obligation to take seriously its duty not to disclose confidential third party information.”
