Job Details
The role of Division Counsel – Commercial Legal is responsible for developing legal strategy for our U.S. Oncology marketed and pipeline products, with a primary focus on the Anti-Kickback Statute, False Claims Act and FDA promotional regulations. The Division Counsel position provides direct legal support to the U.S. Oncology business unit, as well as supervises an attorney in AbbVie’s Commercial Legal group.
Key Responsibilities Include:
- Serving as lead counsel for Oncology pharmaceutical products, and providing substantive advice to Marketing, Medical Affairs, Regulatory Affairs and other departments concerning a broad range of legal, regulatory and compliance issues. These include FDA regulations, False Claims Act, Anti-Kickback Statute, OIG guidance, the PhRMA Code, the Sunshine Act, Foreign Corrupt Practices Act and competition law.
- Providing clear advice to business clients and senior legal management on product-specific issues, including new product/indication launches, patient support models, marketing strategies, promotion, scientific exchange, regulatory submissions, and managed healthcare contracting strategies.
- Interpreting complex agreements, including collaboration agreements, and advising on situations that may arise related to the agreements.
- Staying up-to-date on developments in healthcare laws and guidelines, and where beneficial to the business, developing strategies to influence healthcare policy.
- Working cross-functionally and finding solutions for business clients consistent with the law, policies/procedures, and AbbVie’s Code of Conduct.
- Being committed to meeting patient unmet needs in Oncology and being energized by rising to new challenges and coming up with creative solutions to serve patients.
- Knowledge of government-related policy initiatives (e.g., drug pricing, 340b, PBMs, telehealth).
- Resolving issues using negotiation, communication skills and legal expertise.
- Managing at least one direct report, which requires a commitment to coaching and professional development.
- This position reports to the Section Head, Global Commercial Legal.
Requirements:
- J.D. required.
- Minimum 10+ years of relevant experience in pharmaceutical/healthcare law.
- Prior management experience preferred.
- Excellent written and verbal communication skills, including the ability to communicate complex legal issues in a simple, understandable manner with colleagues across the company.
- Strong collaborative skills, able to build partnerships internally and with external partners at all levels of the organization.
- Strong organization and time management skills with flexibility, creativity, resourcefulness to successfully prioritize and manage multiple, competing priorities simultaneously.
