Job Description - Senior Counsel I, Government Affairs and Public Affairs GTAL Attorney (“Global Therapy Area Legal”)

Specific Responsibilities

The Public Affairs and Government Affairs Business Conduct attorney is responsible for providing legal support in relation to Gilead's corporate external communications. The primary clients for this role include personnel in Public Affairs and Government Affairs but will also be responsible for interacting and managing projects with the Patient Engagement team within Medical Affairs. This role also requires working closely with colleagues who support the Gilead products, Global Compliance, Privacy, Regulatory and other groups to ensure compliant interactions with external stakeholders including patients, policy makers and the public. The attorney will be expected to collaborate with attorneys in our International Legal, Pricing and Access, Competition Law, Intellectual Property and other legal functions.

The Public Affairs and Government Affairs Business Conduct attorney provides legal and compliance input into global strategies and tactics, drives alignment and consistency across the various therapeutic areas where we develop investigational drugs for commercialization. The Public Affairs and Government Affairs Business Conduct Attorney would also conduct, assist and/or provide input into our business conduct policies, training, monitoring, auditing, communications, enforcement, and defense of investigations.

The role can be either based in Foster City, California or remote, reporting to the Senior Director-Head of the Global Public Affairs and Government Affairs Support in the Commercial Legal Department.

This role requires a person that can identify, communicate, coordinate and manage various issues, projects and initiatives simultaneously and across geographies and cultures. This role also requires a person who can proactively engage stakeholders in advising on legal issues and coming to appropriate resolutions in a timely manner.

Essential Duties and Job Functions
  • Serve as the point of contact and provide proactive strategic and tactical legal and business conduct advice to Government Affairs and Public Affairs on matters which span across therapy areas. In particular the successful candidate will be primary point of contact:
    • For the US based patient engagement team; advising on projects to better engage with patients within Gilead. Including Health Literacy, Plain Language Summaries and Patient Councils and working with various functions and legal teams across Gilead to develop processes for greater patient inclusion;
    • Provide US legal review on all corporate communications put out on social media.
  • Work with Head of Public Affairs and Government Affairs Support to develop an in-depth understanding of the business (scientific data, clinical practice, health economics, political, environmental factors) and in particular:
  • Deliver early advice on proposed strategies for interactions with policy makers, politicians and other public officials as well as the media and patient advocacy groups to ensure that they are developed and executed in a manner which is fully compliant with applicable healthcare laws and regulations and with the Gilead Policy and Business Conduct policy and procedures


  • Review and engage on day-to-day activities to spot issues, ensure appropriate business conduct training and oversight of vendors and agents retained by the business;
  • Ensure a high degree of integration and understanding in business conduct policies and procedures and work with the business to proactively identify and then mitigate areas of potential risk.
  • Partner with the Global Therapeutic Area Leads within the Global Therapeutic Area Legal team to ensure alignment and consistency in the advice provided to Public Affairs and Government Affairs.
  • Partner with the Global Compliance Team to provide insights into Training and Monitoring, as well as, with Risk Assessments/Anti-Bribery-Anti-Corruption, and Value and Access to coordinate our global efforts.
  • Maintain awareness and understanding and keep up to date on relevant healthcare laws, rules codes, industry best practices and enforcement environment.
  • Recommend improvements to the company's policy framework, monitoring and business conduct program based on identified industry best practices and collaborating with the Global Compliance to develop such improvements


Qualifications

  • Have a Juris Doctorate from a nationally recognized accredited law school.
  • Be a member in good standing of the State Bar of California, or ability to acquire status of Registered In-House Counsel from the California Bar
  • 6-8 years prior in-house or law firm experience providing legal counsel on the laws and regulations relating to drugs or devices, demonstrating growth and ability to succeed.
  • Detailed knowledge of the US Anti-Kickback Statute, False Claims Act, HIPAA, privacy-laws, advertising laws and regulatory guidance, Food, Drug and Cosmetic Act and other government regulation of pharmaceutical products OR similar laws internationally is required. Specifically, familiarity with laws, regulations and codes outside the US is a plus.
  • Familiarity with these additional areas is also helpful: Foreign Corrupt Practices Act and other relevant anti-bribery laws, guidance on Patient-Focused Drug Development activities, and legal contract principles.
  • Must have demonstrated high EQ and client-service orientation; able to recognize and respond quickly and pragmatically to urgent situations and demanding clients.
  • Must have demonstrated skills, depth and expertise depending in area(s) of responsibility.
  • Have exceptional and demonstrated written and verbal communication skills.
