What you will do

In this vital role you will be responsible for day-to-day counseling Amgens commercial Value & Access organization on a wide variety of legal and regulatory issues. The Value & Access organization is responsible for ensuring patient and provider access to Amgen's medicines including all 22 Amgen products currently marketed in the United States with revenues of approximately US$18.5 billion including all 22 Amgen products currently marketed in the United States with revenues of approximately US$18.5 billion.

Responsibilities of Counsel supporting the Value & Access organization may include:
  • Advising and counseling on complex commercial transactions on price concession strategies and risk mitigation with members of the healthcare community (managed care organizations, hospitals, Group Purchasing Organizations (GPO) and distributors), with emphasis on the Anti-Kickback Statute and applicable antitrust laws

  • Advising and counseling on the issues relating to Amgens patient access support programs or other platform matters that may potentially impact more than one of Amgens products, with emphasis on the Federal Anti-Kickback Statute and government enforcement activities relating to patient access support programs. These programs include copay cards, coupon programs, vouchers, free goods, trial/starter programs, access/reimbursement support hubs, nurse educator programs and pharmacy programs.

  • Drafting and negotiating discount agreements, vendor agreements, supply agreements and/or value-based agreements to provide for strategic pricing of Amgen products and patient support

  • Advising key stakeholders on legal, regulatory and policy developments to ensure that legal support is adapted to a rapidly changing environment

  • Overseeing agreement interpretation and contract enforcement, advising and managing commercial dispute resolution, including providing support for audits

  • Supporting healthcare compliance related matters as they relate to implementation of these programs and agreements

  • Developing and providing ongoing training to commercial operations staff regarding legal and regulatory requirements for commercial activity and contract requirements in the biopharmaceutical industry

  • Helping Amgen shape external environment to improve patient access to its vital medicines

  • Coordinating legal support by contributing as a member of cross-functional team and interacting with business and law department colleagues on various matters

Basic Qualifications:

J.D. degree or LL.M. degree from an accredited law school, admission to practice law in a U.S. jurisdiction, and two (2) years of experience practicing law

Preferred Qualifications:

4+ years of corporate and/or law firm experience

Strong qualifications in transactional work in any industry, including structuring, advising and counseling on complex transactions and drafting, negotiating and interpreting complex contracts.

In-house and/or law firm experience providing counsel on, and structuring, patient access support or similar type programs.

Amgen understands that a candidate may not have all the preferred qualifications, and is open to candidates that have strong, relevant experience in only certain of these areas but is willing to learn new areas. We are looking for a candidate with proven superior legal skills, including excellent oral and written communication, legal analysis and negotiation skills.

The candidate should have:
  • Experience counseling clients on sophisticated legal and regulatory considerations

  • Ability to lead and influence others

  • Strong client service, business counseling and problem-solving focus

  • Ability to manage multi-dimensional projects in a fast-paced environment

  • Superior academic achievement

Experience in healthcare industry is a plus but not required, including counseling on:

  • Healthcare fraud and abuse matters

  • OIG compliance guidance and advisory opinions

  • DOJ settlements with pharmaceutical industry

  • Medicare/Medicaid reimbursement and contracting

  • Congressional hearings and inquiries
