Job Description

At Kite, we are focused on the cure. Our singular focus is on cell therapy — the use of genetically modified immune cells programmed to target tumors — which we believe has the potential to change the way cancer is treated.

Kite is looking to add an Associate General Counsel or our legal team to be responsible for providing general legal, regulatory and healthcare compliance support primarily to Commercial groups of Kite.

This position will be the lead product lawyer managing one of our premier cell therapy assets.

Counsel

Provide Legal analysis and advice to business partners in Kite on broad range of legal matters across entire Kite business in order to inform business partners of risks and help identify appropriate path forward in complex and evolving legal and regulatory environment. For example:
  • Understand and actively provide legal analysis and advice related to new and existing strategies.
  • Exercise judgment during times of ambiguity or conflict while providing guidance
  • Proactively stay abreast of latest development in key areas of Legal expertise that have an impact on current and long-term profitability of the company

Contracts & Agreements

Draft, negotiate and review a wide range of agreements typical to biotech supporting commercial, medical and other activities. Advise on contract interpretation, dispute resolution and other legal risks

Function & Team Leadership

Actively contribute to Legal Function through participation in initiatives to build departmental knowledge and capabilities by sharing best practices

Partner with colleagues to contribute expertise as needed

Mentor among the legal team and provide expertise, guidance and support

Assist Vice-President Commercial Legal on matters of significant importance to the Kite business.

Be committed to meeting patient unmet needs and be energized by rising to new challenges and coming up with creative yet compliant solutions to serve patients. Be energized by challenging and interesting legal work and novel business problems.

Risk Management & Compliance

Partner with Compliance to proactively identify and manage potential compliance risk. Ensure compliance with all government regulations and mandates. Contribute to investigations as needed to address potential compliance concerns.

Regulatory Materials & Promotions

Partner with commercial, regulatory, and medical colleagues to ensure timely review of proposed activities and materials. Contribute actively to the review team by evaluating potential risk and providing counsel. Ensure coordination with other legal associates supporting specific therapeutics to ensure consistency. Provide legal advice and assistance related to commercial programs, including patient assistance, marketing programs and promotional campaigns in accordance with laws and internal policies.

EXPERIENCE & QUALIFICATIONS:
  • 12+ years of legal practice
  • 3+ years of related experience in legal counseling role specifically related to pharmaceuticals, Biotech or medical devices in industry or major law firm
  • JD degree
  • Significant experience in commercial contracting, including drafting, reviewing and advising business partners on complex agreements
  • Familiarity with FDA regulations, federal fraud and abuse laws, including FDA/OIG guidelines, False Claims Act, Anti-Kickback Statute, Industry Codes and privacy laws and requirements affecting commercial and medical activities
  • Experience with product launches including accelerated approvals
  • Strong business acumen and understanding of the pharmaceutical/biotechnology/device business and related legal issues
  • Excellent communication, interpersonal and presentation skills
  • High level of maturity, presence, and discretion in handling of sensitive and confidential information
  • Desire or experience to manage a small team of attorneys providing strategic coaching and direction to meet the needs of the business compliantly.

  • Strong analytical and organizational skills
  • Ability to manage and influence across cross-functional matrix organization
  • Demonstrated ability to work in fast-paced complex environment
  • Up to 10% travel required
