The Division Counsel, Head of Brand Legal is responsible for leading a team of attorneys focused on developing legal strategy and guidelines for our U.S. marketed and pipeline products as well as coordinating on our U.S. Managed Care strategy. The role includes three main components:

  1. Lead our Brand Legal team which focuses primarily on the anti-kickback statute, false claims act and advertising and promotional regulations;
  2. Lead our policy attorney who is accountable for assessing and developing strategy on various policy-related issues impact our US business (e.g., DTC revisions, Part B and D reform); and
  3. Coordinating with our Managed Care Legal team which handles market access-related issues, including rebate strategy and contracting, specialty pharmacy agreements, and US government price reporting requirements.

Key Responsibilities Include:
  • Through a team of experienced attorneys, the Division Counsel will be accountable for the development and execution of strategic legal guidance for the brand team and coordinating closely with the Managed Care team.
  • Handling department budget - both internal spend (e.g., travel, salary) and external outside counsel spend and development of talent within legal organization.
  • Ensuring compliance with applicable company policies and procedures and AbbVie Code of Conduct.
  • Member of the US Area Management Team responsible for advising Senior Commercial, Regulatory, Compliance and Medical leadership on strategic and tactical issues regarding our marketed and pipeline products and managed care strategies.
  • Providing clear advice to various business clients and senior legal management on U.S. laws focusing on promotion, patient support, go-to-market strategies (including managed care, public and private payers, government and commercial contracting, and government price reporting obligations/implications) with specific focus on Federal and State Anti-Kickback laws and False Claims Act.
  • Regularly interpreting complex collaboration and managed care agreements and advising on complex situations that may arise related to the agreements.
  • Developing legal strategy on brand-specific issues, including new patient support models, marketing strategies, government and commercial managed healthcare contracting strategies.
  • Staying up-to-date on developments in relevant laws and guidelines, and where beneficial to the business, taking leadership legal positions in industry/trade organizations to advance business interests.
  • Identifying unmet needs and future legal issues and actively developing strategies for addressing them.
  • In-depth knowledge of Government-related policy initiatives (e.g., Part B/D redesign, DTC regulations, reference pricing) required.
  • This position reports to the Vice President, Global Commercial & HEOR Legal.

  • J.D. required
  • Minimum 10+ years of related experience (previous pharma experience a plus).
  • Expertise in the above practice areas
  • Prior management experience is a plus
