Millennium Laboratories Issues Statement On U.S. Court Jury Verdict In Florida

SAN DIEGO, June 16, 2014 /PRNewswire/ -- Today, a federal jury in Tampa, Fl. (Case #8:11-cv-00775) ruled against Millennium's cup program in claims affecting four states. In response, Millennium issued the following statement:

"While we respect the jury's decision, we vehemently disagree and are disappointed that the jury went against decades of established federal and state health care law and the opinion of the nation's leading health care law experts.

"Although the jury's decision impacts Millennium's cup program in only four states, affecting only a small percentage of our customers, we have voluntarily agreed to suspend the program nationwide and will take immediate action to ensure full compliance while we appeal the decision. The jury's decision does not affect the vast majority of Millennium customers, who either purchase cups and seek reimbursement for that testing or choose not to perform point of care testing at all.

"Millennium takes compliance very seriously. Ethical business practices and compliance with state and federal health care laws have been, and always will be, vitally important to us. Throughout our history, Millennium has invested our resources in research and development of new technologies, improved turnaround time, and enhanced customer service, all while promoting fair, compliant and legal business practices.

"Five years ago Millennium consulted with leading health care lawyers to construct a cup program compliant with federal and state health care laws. During trial, Millennium called as one of its expert witnesses former Chief Counsel to the Office of Inspector General Lewis Morris, who testified that Millennium's cup program was fully consistent with fraud and abuse laws and that Millennium's compliance program meets or exceeds OIG's model compliance guidance and advice.
