(NYSE: ACT) today confirmed that the United States District Court for the District of Delaware has found United States Patent No. 5,100,899 (the '899 Patent) valid and infringed by Actavis' generic version of Pfizer Inc.'s Rapamune® (sirolimus). The Company said that it was reviewing the court's decision and would evaluate all available options, including an appeal.
Rapamune® tablets are indicated for the prophylaxis of organ rejection in patients aged 13 years or older receiving renal transplants. Actavis' Abbreviated New Drug Application ("ANDA") for its generic version of Rapamune® has not yet received tentative or final approval from the U.S. Food and Drug Administration.
