San Diego's KFx Medical Corporation Files Patent Infringement Suit Against Arthrex, Inc.

SAN DIEGO -- (BUSINESS WIRE) -- KFx Medical Corporation (www.kfxmedical.com), a San Diego based medical devices company that develops and manufactures soft tissue fixation implants and bone anchors used in orthopedic surgeries and sports medicine procedures (including those procedures performed on overhead athletes such as baseball players), announced today that it filed a patent infringement lawsuit in the United States District Court for the Southern District of California against Arthrex, Inc., a Naples, Florida based company.

In the suit, KFx Medical alleges that Arthrex infringed and continues to infringe a KFx Medical patent (U.S. Patent No. 7,585,311) that broadly covers the method of knotless double row rotator cuff repair. Arthroscopic knotless double row repair techniques are widely used to restore a torn rotator cuff to its anatomic position and encourage healing. Studies published in leading medical journals including the American Journal of Sports Medicine have demonstrated the superiority of the double row repair of rotator cuff tears. Rotator cuff injuries are a common shoulder injury and frequently seen in overhead athletes such as baseball players.

In 2011, an anonymous party filed a request that the U.S. Patent Office re-examine the KFx Medical patent. During 2010, only 780 patent re-examination requests were filed, while in that same year over 200,000 patents were issued. The U.S. Patent Office rejected all arguments made by the anonymous party and upheld the KFx Medical patent.
