Par Pharmaceutical, Inc. To Pay $100 Million To Settle Suit Over Generic Heartburn Drug

Raleigh’s Salix Pharmaceuticals reached a patent settlement with generic drug company Par Pharmaceutical in which the generic drug maker will pay $100 million.

Patents are awarded by the U.S. Patent Office (“USPTO”), but may be challenged both in the USPTO or separately through the judicial system. For this reason, the validity of many patents isn’t established until one company challenges the patents owned by another company. In some cases, a court will rule that the patent never should have been issued in the first place, making it invalid.
