Forest Laboratories, Inc. Sued by Doctor for Sending Junk Faxes

There are nuisance suits, and then, there are nuisances. And to a cardiology practice in St. Louis, Forest Laboratories has made a nuisance of itself by continually faxing invitations to attend seminars that were held to promote its medications. And so, the St. Louis Heart Center has filed a lawsuit in Federal court that claims the drugmaker violated the Telephone Consumer Protection Act by sending at least 40 unwanted missives since 2010 inviting itsthe internist to learn about the Bystolic hypertension drug. Sometimes, the doctor was invited to such swanky venues as Morton’s Steakhouse and Ruth’s Chris Steakhouse. Often, the faxes invited the doctor, Ronald Weiss, to teleconferences. In his lawsuit, the doctor claims Forest violated the law – which you can read here – by continually sending faxes without an invitation or permission to do so. And so, the doctor is seeking up to $1,500 for each violation, or a grand total of $60,000.
