EndoChoice Files Suit for Patent Infringement

ALPHARETTA, GA--(Marketwire - December 15, 2011) -

EndoChoice, Inc. announced today it has filed a Complaint against Austin Medical, Inc., AVID Medical, Inc., and Cygnus Medical LLC, in the U.S. District Court for the Northern District of Georgia, alleging that each defendant makes and/or sells a scope transport pad that infringes EndoChoice's U.S. Patent No. 8,042,688 (the '688 patent). The '688 patent was issued by the U.S. Patent and Trademark Office in 2011 and covers EndoChoice's innovative Cinchpad® product.

In its Complaint, EndoChoice alleges the Scope Transport Pad sold by each of the defendants, as well as the Kangaroo™ Transport Pad sold by Cygnus Medical, infringes EndoChoice's '688 patent. The Complaint seeks damages as a result of the defendants' infringement of the '688 patent, as well as a preliminary and a permanent injunction against any further infringement of the '688 patent.

EndoChoice's proprietary CinchPad® combines an absorbent pad and impermeable membrane, protecting the work surface and equipment during a gastrointestinal (GI) procedure. The drawstring feature enables staff to easily enclose the contaminated GI endoscope during transport.

"EndoChoice recognized that GI facilities needed a way to meet stringent society guidelines that were developed to prevent cross-contamination and protect staff," said Will Parks, EndoChoice's Co-Founder and VP of Product Development. "The CinchPad® is becoming a procedural staple due to its proprietary technology facilitating standardization and compliance. The related '688 patent is valuable intellectual property that is the product of EndoChoice's ongoing innovations in the field of GI endoscopy."
