WALTHAM, Mass., Dec. 16 /PRNewswire-FirstCall/ -- Inverness Medical Innovations, Inc. , a leading manufacturer and marketer of rapid diagnostics products for the consumer and professional markets, announced today that United States Court of Appeals for the Federal Circuit has issued an order temporarily granting a stay of the injunction against Acon Laboratories issued by the United States District Court for the District of Massachusetts on November 19, 2004. The Federal Circuit's order explicitly states that the temporary stay is not based on a consideration of the merits, but is intended only to preserve the status quo pending receipt and consideration of responses from Inverness and co-plaintiff, Church & Dwight Co., Inc. to Acon's recent motion for stay pending appeal. The plaintiffs are required to respond by December 23, 2004.
