DES MOINES, Iowa, March 17 /PRNewswire/ -- Kemin today responded to a U.S. Court of Appeals three-judge panel ruling denying a preliminary injunction against Pigmentos Vegetales del Centro S.A. de C.V. (PIVEG) for the manufacture of purified lutein. Kemin sought a preliminary injunction on claims that PIVEG is violating a patent licensed to Kemin on purified lutein compositions. Purified lutein is a nutritional ingredient used in supplement and food products.
"We strongly believe in the validity of our patents for the manufacture and compositions of purified lutein and disagree with this decision. We plan to pursue further review of the decision," said Elizabeth Nelson, general counsel for Kemin.
The decision issued today addresses only one of two patents Kemin has asserted against PIVEG. Trial on the merits of the case is scheduled for this fall.
